These Terms of Service and End User License Agreement ("Terms") are a legal agreement between you ("you" or "user") and Skyline Analysis Drone Services, LLC, the developer and operator of ZENITH ("we," "us," or "our").
By downloading, installing, or using ZENITH (the "App"), you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old to use ZENITH. By using the App, you represent and warrant that you meet this age requirement.
You must be 18 or older to use ZENITH, create an account, or make any in-app purchases. By using the App, you confirm you are at least 18 years old.
Subject to your compliance with these Terms, Skyline Analysis grants you a limited, non-exclusive, non-transferable, revocable license to download and use ZENITH on devices you own or control, solely for your personal, non-commercial use.
This license does not include the right to:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any proprietary notices or labels
- Use the App for any commercial purpose without our written permission
- Sub-license the App to any third party
ZENITH is distributed through the Apple App Store. If you download ZENITH from the Apple App Store, the following additional terms apply:
- These Terms are between you and Skyline Analysis only — not Apple
- Apple has no obligation to provide maintenance or support for ZENITH
- Apple is not responsible for any claims relating to ZENITH, including product liability, consumer protection, or intellectual property claims
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
You must also comply with the Apple App Store Terms of Service.
To use ZENITH, you must create an account using your email address. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials secure and confidential
- Notify us immediately at support@skylineanalysis.com if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
You may not create an account on behalf of another person without their authorization.
ZENITH offers two tiers:
- Free Tier — access to core features at no charge
- Pro Tier — access to premium features, available for:
- $9.99 per month, or
- $69.99 per year
Prices are listed in USD and may vary by region as determined by the Apple App Store.
Subscriptions are managed through the Apple App Store and RevenueCat. When you subscribe to ZENITH Pro:
- Your subscription begins immediately upon purchase confirmation
- Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
- Your Apple ID account will be charged upon confirmation of purchase and at each renewal
To manage or cancel your subscription, go to Apple ID Settings → Subscriptions on your device.
If we offer a free trial, it will be clearly disclosed before you start it. Any unused portion of a free trial will be forfeited when you purchase a subscription.
All purchases are processed by Apple and are subject to Apple's refund policy. We do not issue refunds directly. If you believe you are entitled to a refund, you must request it through Apple:

We have no ability to override Apple's refund decisions.
We may change subscription pricing from time to time. We will provide reasonable advance notice of any price changes. Your continued use of a subscription after a price change takes effect constitutes acceptance of the new price.
We reserve the right to modify, add, or remove features from either the Free or Pro tier at any time. We will make reasonable efforts to notify users of significant changes to Pro features.
You agree to use ZENITH only for lawful purposes and in a way that does not infringe the rights of others. You agree not to:
- Use the App for any illegal purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Interfere with or disrupt the integrity or performance of the App
- Use the App to harass, abuse, or harm other individuals
- Upload or transmit any viruses, malware, or other harmful code
- Use automated scripts, bots, or scrapers to interact with the App
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use the AI coaching feature to generate or solicit harmful, illegal, or abusive content
- Misrepresent your identity or impersonate any person
We reserve the right to suspend or terminate your account for violations of these rules.
ZENITH includes an AI-powered coaching feature to help you build habits and achieve goals. Important limitations apply:
- The AI coaching feature is powered by third-party AI providers (Anthropic and/or OpenAI)
- AI responses are generated automatically and may not always be accurate, current, or appropriate for your situation
- The AI coaching feature is not a substitute for professional advice of any kind — including but not limited to medical, psychological, therapeutic, nutritional, fitness, legal, or financial advice
- Do not use the AI coaching feature in place of consulting a qualified professional for serious personal, health, or safety matters
- We are not responsible for decisions you make based on AI coaching responses

ZENITH, including its design, code, branding, features, and content, is owned by Skyline Analysis and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of ZENITH to you.
You retain ownership of the content you create in ZENITH (e.g., habit names, notes, coaching messages). By using the App, you grant Skyline Analysis a limited license to store, process, and display your content as necessary to provide the service.
If you submit feedback, suggestions, or ideas about ZENITH, you grant us a royalty-free, irrevocable, perpetual license to use and implement that feedback without any obligation to you.
ZENITH IS NOT A MEDICAL APP.
ZENITH is designed to help you track personal habits and build routines. It is a productivity and self-improvement tool only and is not intended to:
- Diagnose, treat, cure, or prevent any disease or medical condition
- Provide medical, therapeutic, or clinical advice of any kind
- Replace consultation with a licensed healthcare provider, therapist, psychologist, or other medical professional
- Monitor or manage any clinical health metric
If you have or suspect you have a health condition, or if you are experiencing a medical or mental health emergency, please consult a qualified healthcare professional immediately or call emergency services.
Any health data accessed through HealthKit is displayed for informational and motivational purposes only. ZENITH's AI coaching feature is not qualified to provide health guidance.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZENITH IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We expressly disclaim all warranties including, but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties that defects will be corrected
- Warranties regarding the accuracy or reliability of AI coaching responses
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
You may stop using ZENITH at any time and delete the app from your device. To delete your account and associated data, use the in-app account deletion feature or contact support@skylineanalysis.com.
Canceling your subscription does not automatically delete your account; you must separately request account deletion if desired.
We may suspend or terminate your access to ZENITH at any time and for any reason, including (but not limited to):
- Violation of these Terms
- Conduct that we determine, in our sole discretion, is harmful to other users, the service, or third parties
- Inactivity (extended periods of no usage)
- Discontinuation of the App or service
Upon termination by us for cause (violations), you are not entitled to a refund. If we discontinue the service entirely, we will provide reasonable advance notice.
Upon termination, your license to use ZENITH ends immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL SKYLINE ANALYSIS OR ANDREW NICHOLSON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to lost profits, lost data, loss of goodwill, personal injury, or property damage, arising out of or in connection with your use of ZENITH — even if we have been advised of the possibility of such damages.
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF ZENITH SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10.00 USD.
- We are not liable for the actions, content, or policies of third-party services integrated with ZENITH (Anthropic, OpenAI, RevenueCat, PostHog, Supabase, Apple).
- We are not liable for decisions you make based on AI coaching responses or HealthKit data displayed in the App.
Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Skyline Analysis Drone Services, LLC and its members, managers, employees, and successors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of ZENITH in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party right
These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, USA, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or ZENITH shall be resolved as follows:
1. Informal Resolution: Before filing any formal claim, you agree to contact us at support@skylineanalysis.com and attempt to resolve the dispute informally. We will attempt in good faith to resolve the matter within 30 days.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Oklahoma. The arbitrator's decision shall be final and binding.
3. Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Oklahoma to prevent irreparable harm, without being required to first arbitrate.
4. Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and Skyline Analysis individually. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
We may update these Terms from time to time. When we make material changes, we will notify you via the app or email. Your continued use of ZENITH after the updated Terms take effect constitutes your acceptance of the new Terms.
If you do not agree to the updated Terms, you should stop using ZENITH and delete your account.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Skyline Analysis regarding ZENITH and supersede any prior agreements.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
